In regard to following rules and making the “right” choice, he is the worst captain.
Of course he always wins, but sometimes he should just say, “This is too risky.” Or “This is completely against protocol.”
They do try and retcon/justify it with the Federation-Klingon war happening at the same time which would make for a less... clean cut flagship commander
But in reality youre right, Kirk probably has more war crimes and prine directive strikes under his belt than Janeway LOL
He wouldn't have cheated on the Kobiyashi Maru test if he was the right fit for Starfleet.
Counterpoint: Starfleet brass were well aware of him cheating on an infamous test and thought "that's our guy!"
